Event Objective:

“Constitutional Morality is not a natural sentiment. It has to be cultivated. We must realise that our people have yet to learn it. Democracy in India is only a top-dressing on an Indian soil which is essentially undemocratic.” by Dr. B.R. Ambedkar.
The principles of morality are upheld whenever justice is to be done, which are entwined with the law. It applies to criminal as well as civil court. The situation becomes complex in Constitutional courts. How should the State treat its citizens is a persistent question. The legislation should pass the test of moral principles so that the State is not discriminatory or unfair.
While the Indian Constitution provides for a federal system with a unitary bias, the Central and State Governments both derive their authority from the Constitution. Of late, use of the doctrine of ‘constitutional morality’ has become much more significant and relevant while interpreting the Indian Constitution by the judges than ever before. The Supreme Court has applied different facets of this progressive and transformative doctrine, as it has come to be known, in a catena of cases, some of which may possibly be counted as the finest and seminal judgments.
